Set Up Tribunal To Solve FDI Disputes: Experts

  • Lack of proper dispute mechanisms in India is deterring many foreign investors despite the change in business climate.
  • Investors want the govt to set up an independent tribunals to expeditiously settle disputes pertaining to India, before having to knock for justice at jurisdictions outside India.
  • If the parties decide to settle the matter by foreign law, the tribunal should adjudicate the matter in India while applying to the agreed foreign law.
  • This will boost investor confidence as there have been several reports of Indian counterparts filing case against the foreign partners solely with the purpose of harassing them.
