Removal of Governor with Change of Guard at Centre not an Easy Task

  • National Democratic Alliance government to pack of the Governors, not an easy task.
  • Governors appointed in 2009 will retire soon but the others who were appointed later will complete their tenure, an example for such a case is Kerala’s Governor Sheila Dikshit who was appointed recently
  • Governors like B.L. Joshi, Sheila Dikshit, J.B. Patnaik and H.R. Bhardwaj are clear that they will not quit and will complete the tenure
  • Several Governors who are appointed by the congress are in no hurry to move and apex court will disapprove the removal of Governors to make way for those favored by any government without a valid reason
  • Union Home Secretary Anil Goswami spoke to the Governors to step down as per the present Government’s desire
  • A five-judge Constitution Bench says that the Governors cannot be removed unreasonably or in an arbitrary manner
  • In the past when the UPA government removed some Governors soon after assuming office in 2009, asserted that it had the right to remove a Governor without any attribution or fault if it did not have confidence in him or her, the Apex Court had rejected the stand
  • According to Additional Solicitor-General K.V. Viswanathan the Governor would be brought into disrepute if it was subjected to the “spoils system” under which the party in power after winning the election rewards its loyalists
