No Executive Takeover of Judicial Appointments: govt.

  • Mr.Jaitley in a meeting held with the Law minister and eminent jurists told that they are clear on not going back to the pre-collegium days
  • A strong difference of opinion is felt amongst the participants, who should be dominant whether executives or judiciary
  • Former chief justice of India V.N.Khare who support the dominance of juidicary in the Judicial Appointment Commission opined that judges should dominate because they work closely with the working of the judges shortlisted for selection
  • BJP led-NDA government assured the collegiums system will not pave way for an executive takeover
  • Mr.Khare opined that judges keep a close watch on the work of the particular judge and often come across their judgments unlike in other departments one needs to depend on the IB report
  • One of the eminent jurists who participated in the consultations K.T.S. Tulsi a senior opined that having a majority of judges in the commission would be old wine in a new bottle and just a collegium by another name
  • Justice A.P.Shah, Law Commission Chairperson also cautioned if a commission is set up in its own cosmetic way it would “only change the circle of ‘high priests’, leaving untouched the mystique behind the ‘sacred ritual’ of appointments.”
