- The Tamil Nadu govt has issued an order appointing the Deputy Commissioners of Police or Tiruchi, Madurai, Coimbatore, Tirunelveli, Salem, and Tiruppur as Executive Magistrates in their respective cities.
- The DCP is equivalent to Superintendent of Police in these districts and can exercise powers under sections 107, 108, 109 and 110 of the Code of Criminal Procedure and conduct inquiry into cases booked by police under these sections.
- Section 107 deals with security for keeping the peace.
- Section 108 – security for good behaviour from persons disseminating seditious matters.
- Section 109 – security for good behaviour from suspected persons.
- Section 110 – security for good behaviour from habitual offenders.
- These are primarily invoked by the police as a preventive measure to maintain public peace and good behaviour. When it is to be invoked against someone, the person would have to execute bond for keeping peace or good behaviour.
- Breach of the bond would invoke action against the offenders.
- In this regard, an Executive Magistrate court was opened in Tiruchi which will soon start conducting inquiries.
